DMCA Policy

Fireboy-Watergirl.com is committed to protecting the rights of copyright holders while balancing the needs of our users. This page explains how to report alleged copyright infringement and how we respond under the Digital Millennium Copyright Act (DMCA).

1. Scope & Purpose

Fireboy-Watergirl.com operates an HTML5 games portal providing browser-playable titles for entertainment and education. We strive to host only content that is properly licensed or permitted for public display. When a copyright owner believes material on our site infringes their rights, we will handle the claim promptly and fairly.

2. How to File a DMCA Takedown Notice

A valid DMCA takedown notice should be submitted by the copyright owner or an authorized agent and must include the following elements:

  • A clear identification of the copyrighted work claimed to be infringed (title, brief description, registration number if available).
  • A precise identification of the allegedly infringing material on our site (include the full URL[s] or other specific location information).
  • Your contact information: full legal name, physical mailing address, telephone number, and an email address where you can be reached.
  • A good-faith statement that you believe the use is unauthorized by the copyright owner, its agent, or the law.
  • A statement, under penalty of perjury, that the information in the notice is accurate and that you are the copyright holder or authorized to act on behalf of the holder.
  • An electronic or physical signature (typed full name is acceptable for an electronic submission).

3. Counter-Notification Procedure

If your content has been removed and you believe this was a mistake or misidentification, you may submit a counter-notification. A valid counter-notice should include:

  • Identification of the removed material and its original location before removal.
  • A statement under penalty of perjury that you have a good-faith belief the material was removed by mistake or misidentification.
  • Your contact information (name, address, telephone, and email) and a statement consenting to the jurisdiction of the appropriate federal court or the court where your address is located.
  • Your electronic or physical signature.

After receiving a valid counter-notice, we may restore the content unless the original complainant files a legal action against the poster within the timeframes required by law.

4. Repeat Infringers

We maintain and enforce a policy for terminating accounts or access for users who are repeat infringers. Repeat infringement is taken seriously and may result in permanent removal of content and denial of service.

5. Good-Faith & Disclaimer

While we make reasonable efforts to verify claims and act swiftly, Fireboy-Watergirl.com does not warrant that all hosted content is free of third-party rights. Many games and assets displayed on our site are supplied by third-party creators, game portals, or public sources. We will act in good faith to remove or disable access to allegedly infringing content when notified correctly.

6. Contact & Recordkeeping

Please keep copies of all correspondence for your records. We will retain notices, counter-notices, and related correspondence in accordance with our internal retention policies and applicable law.

7. Policy Updates

We may update this policy to reflect regulatory, technical, or operational changes. The date below shows when this page was last revised.
